It is believed that this image qualifies under the fair use guidelines in the List of GM-EMD locomotives article because:

• The image is a picture of one of the trains described by the article.
• The image depicts the train as it appeared in 1937.
• No free equivalent can be created because images of the train can no longer be obtained. Train has been scrapped.
